1. Introduction

Welcome to Horizons360 Inspection Software ("Horizons360," "we," "us," or "our"), a software application operated by Open Horizons RV, LLC.

Horizons360 provides tools designed to assist RV inspectors and other authorized users with documenting inspections, organizing inspection information, generating reports, and managing inspection-related records.

By accessing or using Horizons360, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must not use the application or related services.

2. Eligibility

You must be at least 18 years old to use Horizons360. By accessing or using the application, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. User Accounts

Account Registration

Certain features of Horizons360 may require you to create an account. You agree to provide accurate, current, and complete information when creating and maintaining your account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account.

Account Security

You must notify Open Horizons RV, LLC promptly if you believe that your account credentials have been compromised or that unauthorized activity has occurred through your account.

4. Horizons360 Services

Inspection Templates and Checklists

Horizons360 may provide inspection templates, checklists, inspection points, categories, and other organizational tools intended to assist users in documenting RV inspections.

These tools are provided for assistance and convenience only. They are not intended to constitute a complete or exhaustive inspection standard for every RV, vehicle, system, component, manufacturer, jurisdiction, or inspection situation.

Users are solely responsible for determining the appropriate scope and methodology of each inspection.

Automated and AI-Assisted Features

Horizons360 may include automated or artificial intelligence-assisted features designed to assist with tasks such as interpreting images, extracting information, generating descriptions, or preparing inspection-related text.

Inspection Reports

Horizons360 may provide functionality for creating, organizing, exporting, or generating inspection reports.

Horizons360 is a software tool and does not independently perform physical inspections or determine whether an RV or component is safe, defective, compliant, or suitable for use.

The user is solely responsible for the accuracy, completeness, professional judgment, and final content of any inspection report produced using Horizons360.

5. Professional Responsibility

Horizons360 is intended to assist qualified users with inspection documentation and related administrative tasks. Use of the application does not replace the knowledge, training, experience, professional judgment, or physical examination required to perform an RV inspection.

Users remain solely responsible for complying with all applicable laws, regulations, contractual obligations, professional standards, manufacturer requirements, and industry practices applicable to their work.

Open Horizons RV, LLC does not certify, license, endorse, or independently verify the qualifications of any user of Horizons360.

6. User Responsibilities

You agree to use Horizons360 responsibly and only for lawful purposes.

You agree not to:

• Use Horizons360 for any unlawful, fraudulent, or unauthorized purpose.
• Attempt to gain unauthorized access to Horizons360, another user's account, or any related system or network.
• Interfere with, disrupt, damage, disable, or overburden the application or its infrastructure.
• Upload malicious software, code, files, or other harmful material.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of Horizons360 except where expressly permitted by applicable law.
• Copy, reproduce, distribute, resell, sublicense, or commercially exploit Horizons360 except as expressly authorized by Open Horizons RV, LLC.
• Use another person's account or credentials without authorization.
• Use the application in a manner that could impair availability or functionality for other users.

7. User Data and Inspection Records

You retain responsibility for the information, photographs, inspection records, customer information, and other content that you submit to or create through Horizons360 ("User Content").

You are responsible for ensuring that you have the necessary rights, permissions, and legal authority to collect, upload, store, and process User Content through Horizons360.

Backup of Records

You should maintain appropriate independent copies of important inspection reports, photographs, customer records, and other business records.

Open Horizons RV, LLC does not guarantee that inspection records or other User Content will be retained indefinitely or remain available without interruption.

8. Privacy

Your use of Horizons360 is also subject to our Privacy Policy, which describes how information may be collected, used, stored, and disclosed.

By using Horizons360, you acknowledge that you have had an opportunity to review the applicable Privacy Policy.

9. Intellectual Property

Ownership

Horizons360, including its software, application interface, functionality, designs, text, graphics, logos, trademarks, documentation, and other proprietary materials, is owned by Open Horizons RV, LLC or its applicable licensors and is protected by applicable intellectual property laws.

Limited License

Subject to these Terms, Open Horizons RV, LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use Horizons360 for your authorized personal or professional business purposes.

No ownership rights in Horizons360 are transferred to you through your use of the application.

10. User Content

You retain ownership of User Content that you lawfully submit to Horizons360, subject to the rights necessary for Open Horizons RV, LLC to provide and operate the services.

By submitting User Content, you grant Open Horizons RV, LLC the limited rights necessary to host, process, transmit, display, and otherwise handle that content as required to provide the Horizons360 services.

You represent that you have the necessary rights and permissions to submit such content.

11. Third-Party Services

Horizons360 may rely on third-party services, infrastructure providers, payment processors, authentication services, cloud storage providers, analytics providers, artificial intelligence services, or other third-party technologies.

Third-party services may have their own terms, conditions, and privacy policies. Your use of such third-party services may be subject to those separate agreements.

Open Horizons RV, LLC is not responsible for the independent operation, availability, security, or policies of third-party services outside of its reasonable control.

12. Service Availability

We may modify, suspend, update, restrict, or discontinue portions of Horizons360 from time to time for maintenance, security, development, operational, business, or other reasons.

We do not guarantee that Horizons360 will always be available, uninterrupted, secure, or error-free.

13. Disclaimer of Warranties

Horizons360 is provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by applicable law.

Open Horizons RV, LLC disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and suitability.

We do not warrant that the application will meet every user's requirements, operate without interruption, be error-free, or produce complete or accurate inspection information.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Open Horizons RV, LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, Horizons360.

This includes, without limitation, claims involving loss of profits, revenue, business opportunities, goodwill, data, inspection records, or other intangible losses.

You acknowledge that Horizons360 is a documentation and software assistance tool and that responsibility for performing inspections and verifying inspection information remains with the user.

15. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Open Horizons RV, LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from or related to:

• Your use or misuse of Horizons360.
• Your violation of these Terms.
• Your violation of applicable laws or regulations.
• Your User Content or the rights of another person or entity relating to that content.
• Your professional inspection activities or services.

16. Termination

We may suspend or terminate your access to Horizons360 if we reasonably believe that you have violated these Terms, applicable law, or otherwise used the service in a manner that creates risk to the application, other users, or Open Horizons RV, LLC.

You may stop using Horizons360 at any time. If account deletion functionality is available, you may also submit an account deletion request through the applicable account deletion process.

Provisions of these Terms that by their nature should survive termination will continue to apply after termination.

17. Changes to These Terms

We may update these Terms from time to time. When changes are made, we may update the Effective Date shown on this page and may provide additional notice when appropriate.

Your continued use of Horizons360 after revised Terms become effective constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to Open Horizons RV, LLC, without regard to conflict-of-law principles, except where applicable law requires otherwise.

19. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

20. Entire Agreement

These Terms, together with the applicable Privacy Policy and any other agreements expressly incorporated by reference, constitute the agreement between you and Open Horizons RV, LLC regarding your use of Horizons360, except where additional terms expressly apply.
